From the whitepaper, page 46, chapter 8.3 "Clearing Failure and Rerouting":

If a transaction fails to reach its final destination, the receiver should send an equal payment to the sender with the same hash, but not disclose R.

This doesn't seem sound to me. If the payment failed to reach the receiver, why should they spend from their own pocket to wire the money back, when the funds are actually locked up somewhere in the route?
